SPRL respects intellectual property rights and expects all users of our platform to do the same. This Copyright & DMCA Policy explains how copyright infringement claims are handled, how rights holders may report alleged violations, and how users may respond where applicable.
Overview
This Copyright & DMCA Policy applies to all SPRL products, services, websites, APIs, and user-generated content made available through our platform.
Although SPRL provides technology and communication services, users remain responsible for the content they create, upload, publish, transmit, or distribute using our Services.
Where applicable, SPRL will investigate reports of alleged copyright infringement and may remove, disable, or restrict access to content that is believed to infringe intellectual property rights, in accordance with applicable laws and this Policy.
This Policy should be read together with our Terms of Service, Acceptable Use Policy, Abuse Reporting Policy, Privacy Policy, and other applicable SPRL policies.
1. Our Commitment to Intellectual Property
SPRL is committed to respecting copyrights, trademarks, and other intellectual property rights. We encourage users to create, share, and distribute only content that they own or are legally authorised to use.
We do not knowingly permit the use of our Services for copyright infringement, piracy, or the unauthorised distribution of protected works.
2. User Responsibilities
By using SPRL Services, you represent and warrant that you have the necessary rights, licences, permissions, or legal authority to use and distribute any content submitted through our platform.
Users must not upload, publish, transmit, or share content that:
- infringes another person's copyright or other intellectual property rights;
- is copied or distributed without the necessary permission or licence;
- circumvents copyright protection measures or digital rights management technologies;
- encourages or facilitates copyright infringement by others.
3. Reporting Copyright Infringement
If you believe that content available through SPRL Services infringes your copyright or other intellectual property rights, you may submit a written copyright infringement notice for review.
To help us investigate efficiently, your notice should include sufficient information to identify the copyrighted work, the allegedly infringing material, and evidence demonstrating your ownership or authority to act on behalf of the rights holder.
Submitting false, misleading, or fraudulent infringement claims may result in the rejection of the request and may have legal consequences under applicable laws.
4. Required Information for a Notice
A copyright infringement notice should include, where applicable:
- the full name and contact details of the copyright owner or authorised representative;
- a description of the copyrighted work claimed to have been infringed;
- the URL or sufficient information identifying the allegedly infringing content;
- a statement explaining the basis of the claim;
- a declaration that the information provided is accurate and submitted in good faith;
- an electronic or physical signature of the copyright owner or authorised representative.
5. Review Process
Upon receiving a sufficiently complete copyright infringement notice, SPRL may review the information provided and take appropriate action where reasonably necessary.
Depending on the circumstances, SPRL may:
- request additional information from the complainant;
- temporarily restrict access to the reported content;
- remove or disable access to allegedly infringing material;
- notify the affected user where appropriate;
- take additional action in accordance with our Terms of Service and applicable laws.
Submission of a notice does not automatically result in the removal of content. SPRL reserves the right to evaluate each report based on the available information and applicable legal requirements.
6. Counter-Notification
If you believe that your content was removed or disabled in error or as a result of mistaken identification, you may submit a written counter-notification where permitted by applicable law.
A counter-notification should include sufficient information to identify the affected content, explain the basis for disputing the claim, and provide a statement that the information submitted is accurate and made in good faith.
SPRL may forward a valid counter-notification to the original complainant and may restore access to the content where appropriate and permitted by applicable law.
7. Repeat Infringers
SPRL reserves the right to suspend, restrict, or terminate accounts that repeatedly infringe the intellectual property rights of others or repeatedly violate this Policy.
When determining whether an account is a repeat infringer, SPRL may consider the number, severity, credibility, and history of infringement reports together with any responses or supporting evidence provided by the affected user.
8. Good Faith Reporting
All copyright complaints and counter-notifications must be submitted honestly, accurately, and in good faith.
Knowingly submitting false, misleading, abusive, or fraudulent copyright claims or counter-notifications may result in the rejection of the submission, suspension of platform privileges, or other action permitted under applicable law.
9. Third-Party Content
SPRL provides technology services that may allow users to create, store, share, or access content originating from third parties. Unless expressly stated otherwise, SPRL does not claim ownership of customer content and does not routinely monitor all user-generated material.
Users remain solely responsible for ensuring that their content does not infringe the intellectual property rights of others and that all necessary permissions or licences have been obtained before using our Services.
10. Service Provider Role
SPRL provides software, communication, analytics, and technology services that enable customers to create, manage, and distribute their own content. Except where expressly stated, SPRL does not create, edit, approve, endorse, or assume responsibility for customer-generated content.
The availability of content through SPRL Services should not be interpreted as confirmation that such content complies with copyright laws or that SPRL has verified the ownership or licensing of that content.
11. Preservation of Evidence
Where reasonably necessary for legal, security, operational, or compliance purposes, SPRL may preserve relevant records relating to reported copyright claims, investigations, account activity, communications, and enforcement actions.
Such records may be retained for an appropriate period in accordance with our legal obligations, internal retention practices, and Privacy Policy.
12. Limitation of Liability
To the fullest extent permitted by applicable law, SPRL shall not be liable for copyright infringement committed by users, customers, or third parties using our Services.
SPRL's role is limited to providing the underlying platform and responding appropriately to valid infringement notices where required by applicable law. Users remain solely responsible for the legality of the content they create, upload, publish, transmit, or distribute through SPRL Services.
13. Policy Updates
SPRL may update this Copyright & DMCA Policy from time to time to reflect changes in applicable laws, legal requirements, industry standards, or our Services.
The latest version of this Policy will always be published on this page together with the last updated date. Continued use of SPRL Services after an updated version becomes effective constitutes acceptance of the revised Policy.
